1.1 These General Terms and Conditions for the Hotel Industry (AGBH 2006) replace the previous ÖHVB of 23 September 1981.
1.2 The AGBH 2006 do not exclude special agreements. Individual agreements take precedence.
Accommodation Provider: Natural or legal person who accommodates guests for payment.
Guest: Natural person who makes use of the accommodation; includes accompanying persons.
Contractual Partner: Person who concludes the accommodation contract.
Consumer / Entrepreneur: Terms according to the Austrian Consumer Protection Act (KSchG).
Accommodation Contract: Contract between the accommodation provider and the contractual partner.
3.1 The contract is concluded upon acceptance of the reservation. Electronic declarations are considered received when accessible.
3.2 The accommodation provider may request a deposit. The contract is valid only after confirmation.
3.3 The deposit must be paid no later than 7 days before arrival. Costs are borne by the contractual partner.
3.4 The deposit is a partial payment towards the total price.
4.1 Check‑in from 4:00 p.m.
4.2 Use before 6:00 a.m. counts as an overnight stay.
4.3 Check‑out by 12:00 noon; a later departure may incur additional charges.
5.1 No deposit → withdrawal possible without grace period.
5.2 If the guest does not arrive by 6:00 p.m., the obligation to provide accommodation expires.
5.3 After payment of a deposit, the reservation is guaranteed until 12:00 noon of the following day.
5.4 Withdrawal possible up to 3 months before arrival.
5.5 Up to 3 months before arrival free of charge.
5.6 Cancellation fees:
5.7 In unforeseeable events, the payment obligation lapses.
5.8 If arrival becomes possible again within 3 days, the payment obligation resumes.
6.1 A reasonable alternative accommodation may be provided.
6.2 Reasons: unusability, overbooking, extensions.
6.3 Additional costs are borne by the accommodation provider.
7.1 Right to customary use of all facilities according to house rules.
8.1 Payment of the total amount.
8.2 Foreign currencies only at the accommodation provider’s discretion.
8.3 Liability for damages caused by the contractual partner, guests, or accompanying persons.
9.1 Right of lien and retention (§970c, §1101 ABGB).
9.2 Additional charges for room service or night service.
9.3 Right to interim billing.
10.1 Provision of the agreed services.
10.2 Special services may be invoiced separately.
11.1 Liability according to §§970 ff ABGB.
11.2 No liability for slight negligence (for entrepreneurs also gross negligence).
11.3 Liability for valuables limited to €550.–.
11.4 The accommodation provider may refuse safekeeping.
11.5 Damage must be reported immediately; limitation period: 3 years.
12.1 Consumers: no liability for slight negligence except for personal injury.
12.2 Entrepreneurs: no liability for slight/gross negligence or consequential damages.
13.1 Animals only with prior approval & possible fee.
13.2 Animals must be supervised.
13.3 Insurance is required.
13.4 Liability for any damage caused by animals.
13.5 No animals in the restaurant, salon, wellness area.
14.1 No entitlement to an extension.
14.2 In case of natural events → automatic extension.
15.1 The contract ends upon expiry of the agreed period.
15.2 Early departure → full price, minus actual savings.
15.3 The guest’s death terminates the contract.
15.4 Open-ended contracts may be terminated by 10:00 a.m. on the third day.
15.5 Immediate termination for important reasons.
15.6 Force majeure → termination possible.
16.1 Medical care is organized.
16.2 In emergencies, action may be taken without instruction.
16.3 Reimbursement of medical costs, cleaning, damages, etc.
17.1 Place of performance: location of the accommodation provider.
17.2 Austrian law applies.
17.3 Entrepreneurs: jurisdiction = location of the accommodation provider.
17.4 Consumers in Austria: court of residence.
17.5 Consumers in EU/CH/NO/IS: court in their home country.
18.1 Deadlines begin upon delivery.
18.2 Delivery must occur by 12:00 midnight.
18.3 Set-off by the contractual partner only partially permitted.
18.4 Statutory provisions apply subsidiarily.
The Hotel Bellevue GesmbH & Co KG assumes no liability for external services.
Complaints must be resolved directly with the provider.
The hotel only provides the premises.
